Terms and Conditions/Disclaimer

General Terms and Conditions (GTC) for Participation in the "Point of Return Race"

1. Conditions of Participation

1.1. The objective of the race is to get as far away as possible from the starting point within a set time (see race registration) and return. Each participant individually chooses their direction and the turnaround point ("Point of Return").

1.2. The winner is the person whose set GPS point is the furthest (as the crow flies, in meters) from the starting point in Münster.

1.3. The reached location must be verified with a GPS point (Google Maps) and a photo. The participant must be visible in the photo along with a recognizable structure (e.g., gas station, street sign, supermarket) at the set GPS point.

1.4. All participants are required to carry the GPS tracker provided by the organizer during the race.

2. Route and Means of Transportation

2.1. The entire distance must be completed using one's own physical power without any motorized assistance. Ferries, cars, trains, or other means of transportation are strictly prohibited.

2.2. All participants are responsible for their own movement, safety, and supplies.

2.3. External assistance is only permitted if it is publicly accessible and equally available to all participants (e.g., public water fountains, shops, supermarkets).

2.4. Support vehicles are prohibited.

2.5. Riding in pairs is allowed, but permanent drafting is not permitted. Carrying equipment for each other is also not allowed. All decisions should be made in the spirit of fairness toward other participants.

2.6. Pre-arranged external support from family, friends, or teams is not allowed. Assistance may only come from publicly accessible sources.

3. Participation and Competition Rules

3.1. All participants must carry or obtain their own food, equipment, and tools.

3.2. The race is scored on an individual basis; there is no team ranking.

3.3. Self-navigation is required using GPS, maps, or other tools.

3.4. Overnight stays in accommodations along the route are allowed. Duration is up to the participant.

3.5. All participants must comply with traffic regulations in the country or region they are in.

3.6. All participants ride at their own risk and must use proper lighting and safety gear (e.g., helmet).

3.7. In the event of bad weather or dangerous conditions, participants decide independently how to proceed.

3.8. Participants who return to the start after the official race time ends will be disqualified, regardless of the distance covered.

3.9. The race directors are available by phone for questions or concerns in case of uncertainty or danger.

3.10. Participants commit to fair behavior toward others and respectful conduct toward the environment. Violations of fairness or consideration may lead to disqualification.

3.11. The organizers reserve the right to exclude participants for valid reasons (e.g., repeated rule violations, unsportsmanlike behavior, deception)—even during the race.

3.12. If a participant decides to abandon the race, the race directors must be informed immediately.

4. Disclaimer and Risk Management

4.1. By participating, participants accept that the organizer is not liable for any damages resulting from race participation.

4.2. Participants act on their own responsibility and release the organizers and initiators of the race from any liability.

4.3. By submitting the registration form, participants agree unconditionally to indemnify the initiators from all liability.

4.4. Participants must comply with the laws of the country they are in. They are solely responsible for any infractions or legal violations.

4.5. Participants are responsible for managing their own recovery. Rest periods must be adjusted to their individual needs. The organizers accept no liability for damages caused by fatigue or inattention (to people, bikes, objects, etc.).

5. Registration and Participation Fee/Refunds

5.1. To participate, individuals must complete a registration form, sign a liability waiver, and pay the participation fee specified by the organizer.

5.2. The participation fee is fully refundable up to 30 days before the race starts. No refunds will be issued from the 29th day before the race.

5.3. However, the race entry may be transferred to another person by the participant. In this case, the race directors must be notified via email.

5.4. If participation is not possible due to an unforeseen and documented event beyond the participant’s control (e.g., illness, serious accident, personal emergency), there is no entitlement to a refund. However, the ticket may be transferred to another person as outlined in point 5.3.

5.5. Refunds only apply to the participation fee. Additional costs (e.g., travel, accommodation, equipment) are excluded.

5.6. Participants must be of legal age.

6. Publication of Results and Images

6.1. By participating, participants agree that their name, timing results, and potentially photos taken during the event may be published by the organizer.

6.2. This may include the race website, social media, and other public channels.

7. Data Protection/Use of Photos and Results
7.1. The organizer is committed to handling participants' personal data in accordance with applicable data protection laws and using it solely for the purpose of the event. Further details can be found in the privacy policy on the event website.

7.2. By registering for the event, you consent to the publication of your name, race results, as well as photos and videos taken during the event on the organizer's website, social media channels, and other forms of public communication.
7.3. Consent to the publication of photos and videos is voluntary and can be revoked at any time with future effect. A simple email to pointofreturn@posteo.de is sufficient to withdraw your consent.

8. Changes and Amendments to the GTC

8.1. The organizer reserves the right to amend or change the GTC at any time. Any changes will be communicated to participants in a timely manner.

8.2. If any individual provision of these GTC becomes invalid, the validity of the remaining provisions remains unaffected.

9. Final Provisions

9.1. German law applies.

9.2. The place of jurisdiction is the organizer’s registered office, if legally permissible.

9.3. In the event of race cancellation due to force majeure, no refund of the participation fee is guaranteed. However, the organizer may offer alternatives, such as partial refunds after deducting costs already incurred (e.g., for pre-booked services). A full refund is not guaranteed.

9.4. To the extent legally permitted, the organizer's liability is limited to gross negligence or willful misconduct. The organizer accepts no liability for damages suffered by participants during the race unless they result from gross negligence or intent.

9.5. If individual provisions of these GTC are or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that most closely reflects the original intent.

10. GPS Tracking and Technical Equipment

10.1. All participants are required to properly use the provided GPS tracker for the duration of the race.

10.2. The tracker must remain switched on at all times and must not be tampered with or deactivated.

10.3. In case of technical issues with the GPS device, the race directors must be informed immediately. As an exception, proof of the route using an alternative GPS-enabled device may be accepted.

10.4. If a participant loses the GPS tracker, it must be replaced at the participant's own expense.

10.5. By participating in the race, participants agree to share their real-time location with the race directors for the duration of the race.

11. Medical Care and Safety

11.1. Participants are encouraged to carry a basic medical kit (e.g., bandages).

11.2. In the event of a medical emergency, participants must contact emergency services as the first priority. The organizers are not obligated to provide medical care.

11.3. Participation requires sufficient physical health. Participants should seek medical advice before the race. The organizer accepts no liability for health problems arising during or after the event. If health problems arise during the race, participants must inform the race directors immediately.

12. Conclusion of Contract and Acknowledgment of GTC

12.1. A binding contract between the participant and the organizer is established upon submission of the completed registration form and receipt of the participation fee.

12.2. By registering, participants confirm they have fully read, understood, and accepted these GTC. The GTC are part of the contractual agreement.

12.3. The version of the GTC valid at the time of registration applies. Changes will be communicated to participants in due course.
